Terms and conditions

1. Who these terms are between

These terms govern every contract between Paketfest, owner Selma Kaya, Bahnhofstraße 41, 44623 Herne ("we"), and the person or organisation booking a party package ("you"). Differing terms of your own apply only if we have agreed to them in writing.

2. How a booking comes about

The prices on this website are an invitation to make an enquiry, not a binding offer. Sending the form places no obligation on you. We answer with a written quote naming the package, the date, the hall, the guest count, the add-ons and the total. The contract exists when you accept that quote in writing or by email and we confirm it. No payment is taken through this website.

3. What the package price covers

The flat price covers hire of the named hall for the hours stated, set-up and take-down, string lights and table décor, the sound system with two microphones, crockery, glasses and cutlery for the booked guest count, the final clean and waste removal, the number of Paketfest staff stated for the package, and the noise notification and GEMA music licence. Food, drink and cake are not included and are yours to arrange.

4. Payment

A booking fee of €200 is due within seven days of the contract and is set off against the total. The balance, together with a refundable damage deposit of €200, is due fourteen days before the party. We accept bank transfer and card. If the balance is not paid by the due date we may withdraw and treat the booking as cancelled under clause 7.

5. Guest numbers and overtime

The package is priced on the hall and the hours, not on a headcount at the door. If your guest number rises above the package maximum before the party, tell us and we will move you to the next package for the difference in price. Time used beyond the booked hours is charged at €90 per hour begun, agreed on site with our lead person and invoiced afterwards.

6. Your obligations

You are responsible for the conduct of your guests and for the condition of the hall during the party. You will not bring pyrotechnics, open flames beyond the tea lights we provide, or your own smoke machine. Where you engage your own caterer, that caterer is responsible for food safety and for leaving the kitchen clean. Damage beyond normal wear is set off against the deposit; where it exceeds the deposit we will invoice the difference against the hall's own assessment, which we will show you.

7. Cancellation and postponement

Cancellation more than 60 days before the party costs you the €200 booking fee and nothing else. Between 60 and 14 days before, 50% of the package price is due, because the hall is already contracted in our name. Within 14 days, the full package price is due. You may move the date once at no charge if you tell us more than 30 days in advance and a hall of the same size is free; a second move is treated as a cancellation and a new booking. Cancellations must be in writing.

8. If we cannot deliver

If we cannot perform because of the hall's own failure, a public order, a power cut, severe weather or another event outside our control, we will offer you an equivalent hall on the same date or the same package on another date of your choosing. If neither works for you, everything you have paid is refunded in full within fourteen days. Beyond that refund we are not liable for consequential loss in these cases.

9. Liability

We are fully liable for injury to life, body or health, for intent and gross negligence, and where we have given a guarantee. For slight negligence we are liable only for breach of an obligation essential to the contract, and then only up to the loss typical for this kind of contract and foreseeable at the time it was made. Our event liability insurance is named in the legal notice. Liability under the Product Liability Act is unaffected.

10. Photographs

We take no photographs at your party and publish none, unless you ask us to and we agree it separately in writing.

11. Final provisions

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Where you are a merchant, a legal person under public law or a special fund under public law, the place of jurisdiction is Herne. Should any provision be or become invalid, the remainder stays in force. There is no consumer right of withdrawal here because nothing is sold or paid for through this website; a contract only comes about after a written quote, and clause 7 governs cancellation.
